Unsolicited ad emails prompt Google privacy complaint

Paris Austrian advocacy group noyb.eu filed a complaint with France’s data protection watchdog on Wednesday against Google for sending unsolicited advertising emails to Gmail users’ inboxes.

Alphabet (NASDAQ:GOOGL), whose revenues mostly derive from online advertising, should ask Gmail users for approval before sending direct marketing emails, noyb.eu said, citing a 2021 EU Court of Justice judgement (CJUE).

Noyb.eu complained that Google’s ad emails look regular but include the word “Ad” in green letters underneath the topic. The advocacy group said they lack a date.

Google and CNIL did not immediately comment.

Vienna-based Max Schrems, an Austrian lawyer and privacy activist, launched noyb.eu (None Of Your Business) in 2020.

The CNIL, one of Europe’s most prominent data privacy regulators, fined Google $150 million for making it impossible to refuse web trackers.
